By accessing this Site, using our Service, or by purchasing goods or services, you agree to be bound by these terms of use and conditions of sale.
THIS AGREEMENT CONTAINS WARRANTY DISCLAIMERS AND OTHER PROVISIONS THAT LIMIT OUR LIABILITY TO YOU. PLEASE READ THIS AGREEMENT IN ITS ENTIRETY.
Privacy
Your privacy is very important to Solid Line. Please review our Privacy Policy to learn how Solid Line collects and uses personal information. The terms of our privacy policy are incorporated into and considered part of these Terms.
Trademarks
All brand, product and service names used in this Service which identify Solid Line or third parties and their products and services are proprietary marks of Solid Line Products, LLC or the relevant third parties. Nothing in this Service shall be deemed to confer on any person any license or right on the part of Solid Line or any third party with respect to any such image, logo or name.
Copyright
You acknowledge and agree that, unless otherwise stated, Solid Line is the owner of all content on this website. You may not publish, distribute, extract, reuse, or reproduce any content without authorization of the Content owner, except for uses permitted by law. You will retain ownership of the Content you upload to Solid Line.
You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Site, in whole or in part.
Responsibility for the Images You Use for Custom Printing
You are responsible for all of the images you upload to use the Service. You must either own all right, title and interest in and to the copyrights in the images or have express permission from the copyright owner to copy and use such images for all purposes related to the Service, and the images may not violate or infringe upon the rights (including other intellectual property rights, privacy, moral or publicity rights) of others. Professional images that are provided to you by professional photographers or made available through websites, magazines, books or other resources, are protected by copyright and should not be uploaded using the Service.
Images you upload for our custom printing services are stored on our secure servers and may remain there for 30 days for back-up purposes in case you need a reprint or your piece is damaged during shipment. Files will be deleted off our servers without any notification so make sure you back up your images. We are not responsible for deleted images.
Reporting Violations of Your Copyrights
If you believe that your Content has been copied in a way that constitutes copyright and/or trademark infringement, please notify Solid Line's Copyright team, and provide the following information ("Notice"):
a description of the copyrighted work and/or trademark that you believe to infringe on your work, providing enough detail so we can locate it on our Site;
provide your name, email address, mailing address, and telephone number
provide an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright/trademark interest;
provide a statement that you have a good faith belief that the disputed use is not authorized by the copyright/trademark owner, its agent, or the law;
provide a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are authorized to act on behalf of the owner of the
copyright/trademark interest involved.

Conduct
You agree not to use the Service:
for any unlawful purposes;
to upload, order for print, email or otherwise transmit or communicate any material that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, vulgar, illegal or otherwise objectionable;
to upload, order for print, email or otherwise transmit or communicate any material that you do not have a right to transmit or communicate under any contractual or fiduciary relationship or which infringes any copyright, trademark, patent or other intellectual property right or any moral right of any party including, but not limited to Solid Line Products;
to upload, post, email or otherwise transmit any material which is likely to cause harm to Solid Line’s or anyone else's computer systems, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorized access to the Service which may cause any defect, error, malfunction or corruption to the Service;
Your Account
If you use this Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Solid Line only sells products to adults who can purchase with a credit card or other permitted payment method. If you are under 18, you may use Solid Line’s Service only with involvement of a parent or guardian. Solid Line reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
Risk of Loss
All items purchased from Solid Line are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.
Pricing and Product Descriptions
Solid Line attempts to be as accurate as possible in describing products for sale. However, Solid Line does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Solid Line is not as described, your sole remedy is to return it in unused condition.
Occasionally, information on Solid Line Products.com may contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing and/or availability. Solid Line reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice, including after your order has been submitted. In the event that you order products and the price published on the Service was incorrect, Solid Line will contact you to let you know the correct price and ask you whether you still wish Solid Line to fulfill your order at the correct price. Any dates specified for delivery of any products are intended to be an estimate only.
In addition, we reserve the right to cancel orders due to lack of availability, including after your order has been submitted. We apologize for any inconvenience this may cause you.
Right to Return
All purchases are subject to Solid Line’s Return Policy.
Amendment of the Terms
Solid Line reserves the right, in its sole discretion, to modify or replace any of these Terms at any time. Applicable Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the state and federal courts of the State of California.
Disclaimer of Warranty and Limitation of Liability
You understand and agree that your use of the Site is at your sole risk. This Site and the information, services, products, and materials available through it are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, Solid Line and its affiliates disclaims any warranties for the security, reliability, timeliness and performance of this service. We do not warrant that the functions performed by the service will be uninterrupted or error-free, or that the site or the servers that support it will be free from viruses or other harmful components. We do not warrant the accuracy or completeness of any content related to products on this site.
You understand and agree that the submission of any digital content or film image to Solid Line, and the download or upload of any material through the service is done at your own discretion and risk and that you will be solely responsible for any loss or damage to your content or image or any damage to your computer system or loss of data that may result in the download or upload of any material. You are solely responsible for creating back-ups of your digital content. In the event of any mistake by Solid Line, such as the shipment of a defective product, we will be liable only to the extent of our return policy.
Except as expressly provided in the preceding paragraph, to the fullest extent allowed by law, we shall not be liable for any indirect, incidental, consequential, special, exemplary and punitive damages arising out of (i) the use of or inability to use Solid Line’s site or the service, (ii) any transaction conducted through or facilitated by the site, (iii) any claim attributable to errors, omissions, or other inaccuracies in the site or the service, (iv) unauthorized access to or alteration of your transmissions or data, or (v) any other matter relating to the site or the service or products offered on the site, even if solid line has been advised of the possibility of such damages. The foregoing disclaimers, waivers and limitations shall apply notwithstanding any failure of essential purpose of any limited remedy. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, some of the above limitations may not apply to you. In such states, Solid Line’s liability is limited and warranties are excluded to the greatest extent permitted by law, but shall in no event exceed $100.00.
You acknowledge that Solid Line does not control in any respect any information, products, or services offered by third parties on or through this Service. except as otherwise agreed in writing, and its affiliates assume no responsibility for and make no warranty or representation as to the accuracy, currency, completeness, reliability or usefulness of content or products distributed or made available by third parties through this Site. You acknowledge that Solid Line makes no warranty or representation that confidentiality of information transmitted through this Site will be maintained.
No advice or information, whether oral or written, obtained by you from Solid Line or through or from the Site shall create any warranty not expressly stated in the Agreement.
Severability
If any provision of these Terms of Use is invalid, illegal or unenforceable under any applicable statute or rule of law, such provision shall be deemed amended to achieve as nearly as possible the same intent as the original provision and the remaining provisions of this Agreement shall in no way be affected or impaired.
Arbitration
These Terms shall be governed by and construed in accordance with the laws of California without resort to its conflict of law provisions. Any dispute with regard to this Agreement shall be submitted to one arbitrator for arbitration in California. The award rendered by the arbitrator shall be binding as between the parties and judgment on such award shall be entered in any court having jurisdiction thereof. The Arbitrator may award attorney's fees and costs to the prevailing party.
Indemnification
You understand and agree that you are personally responsible for your behavior in connection with the Service. You agree to indemnify, defend and hold harmless Solid Line and its subsidiaries, affiliated companies, joint venture partners, business partners, licensors, employees, agents and any third-party information providers to the Service from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of (a) images or other content you submit through the Service, (b) use or misuse of the Service by you or any other person who accesses the Service using your account, (c) any violation of these Terms of Service or (d) any violation of any rights of a third party.
General
No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by these Terms. Solid Line may assign its rights and responsibilities hereunder without notice to you. The failure of a party to exercise or enforce any right or provision of these Terms will not constitute a waiver of the right or provision. Solid Line's failure to act with respect to a breach by you or others does not waive Solid Line's right to act with respect to subsequent or similar breaches. If any provision of these Terms is invalid, illegal or unenforceable under any applicable statute or rule of law, such provision shall be deemed amended to achieve as nearly as possible the same economic effect as the original provision and the remaining provisions of these Terms shall in no way be affected or impaired. These Terms constitutes the entire agreement between you and Solid Line and supersedes all other communications, written or oral, with regard to the services provided by Solid Line.
